In the zerohedge.com article, the keyword used is "legalized". That is what I questioned.

藏金于民 - that is China's policy.

With the high mintage of 2011-2012, the silver BU panda are positioned as bullion investment coin (投资)and the proof coin as collector coins (收藏). That at least seems to be the general consensus in China.
